Action based on rights over the parking space
Security Parking operates within the rights held by the owner, tenant, operator or another person authorised to manage the parking spaces concerned.
This person is referred to as the entitled person. They may use Security Parking themselves or entrust the monitoring of their spaces to people they have authorised.
An unauthorised occupation is therefore generally recorded by someone who is present at the location and familiar with the rules applying to the car park.
What is the purpose of the mandate granted to Security Parking?
The mandate allows Security Parking to act on behalf of the entitled person when processing reported situations.
Depending on the agreed services, it may authorise Security Parking to:
- Process compensation requests.
- Answer questions and handle disputes.
- Take the necessary steps to identify the registered keeper.
- Manage payment follow-up and reminders.
- Represent the interests of the entitled person in procedures relating to the relevant case files.
The mandate does not transfer any rights over the parking spaces to Security Parking. The entitled person retains control of the car park and decides who is authorised to record cases.
The entitled person can record cases personally
The owner, tenant or operator of a parking space can personally document an unauthorised occupation.
They will generally know the intended use of the space, the authorisations granted and the applicable rules. They are therefore well placed to determine whether a vehicle is permitted to use the space.
For occasional use, an entitled person may also report a case without creating an account, provided they confirm that they hold the necessary rights over the space concerned.
An employee may be authorised to use the application
Within a company, property-management business, shop or other organisation, cases may be recorded by one or more authorised employees.
These may include:
- A site manager.
- A caretaker or member of the technical department.
- An employee responsible for reception or car-park management.
- A person responsible for monitoring access.
- A member of the management or administrative team.
Access can be organised so that the relevant people use the application as part of their duties.
A third party may be specifically appointed
The entitled person may also entrust the controls to an expressly authorised third party.
This could, for example, be an external caretaker, a site manager or someone specifically responsible for monitoring several parking areas.
That person acts on behalf of the entitled person. They must understand the car-park rules, the limits of their authority and the situations that need to be documented.
A security company may carry out the controls
A private security company or external partner may also incorporate Security Parking into its monitoring services.
Its agents can document situations observed during their patrols, place the appropriate tickets on vehicles and submit the case files through the application.
This arrangement can make it possible to:
- Integrate parking controls into existing security patrols.
- Entrust the controls to staff who are regularly present at the location.
- Monitor several sites.
- Offer the owner or car-park operator a complete service.
The security company acts within the authority granted by the entitled person.
What is the role of the person recording the case?
The person present at the location documents the factual situation. In particular, they must:
- Check that the vehicle is not authorised to occupy the space.
- Consider any known authorisations or exceptions.
- Take clear photographs of the vehicle, its registration number and the parking space.
- Verify the information recognised by the application.
- Select the appropriate ticket or type of action.
- Follow the instructions defined by the entitled person.
This person has no police powers and does not issue a fine. They document the occupation of a private parking space so that the rights of the entitled person can be examined and, where necessary, exercised.
What happens next, and what is Security Parking’s role?
Security Parking provides the application, tickets and tools needed to document and process the cases.
Once the case file has been submitted, Security Parking may notably handle:
- Making the information available to the motorist.
- The administrative processing of the request.
- Questions and disputes.
- The necessary enquiries and reminders.
- Payment follow-up.
- The settlement statement provided to the partner.
The roles are therefore clearly divided: the authorised person documents the situation at the location, while Security Parking processes the case file in accordance with the mandate received.
An organisation adaptable to every car park
There is no single way to organise the recording of cases.
For an individual parking space, the entitled person may act personally. For a shop or company, the task may be entrusted to employees. For a larger site or one requiring regular controls, a dedicated person or security company may be appointed.
The essential point is that every case is recorded by an authorised person who is present at the location and properly informed about the applicable rules.
